Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of Sophon software and related services provided by Buildersoft LLC ("Buildersoft," "we," or "our"). By downloading, installing, or using Sophon, you agree to these Terms.
2. License
2.1 Personal Tier
The Personal tier of Sophon is provided free of charge for individual, non-commercial use. You may self-host a single instance for personal purposes.
2.2 Pro & Enterprise Tiers
Pro and Enterprise tiers require a valid license key purchased from Buildersoft. Licenses are per-instance and non-transferable. Enterprise licenses include additional terms as specified in your enterprise agreement.
2.3 Restrictions
You may not:
- Redistribute, sublicense, or resell Sophon or its components
- Remove or alter any proprietary notices or labels
- Use Sophon to provide a competing hosted AI assistant service
- Reverse engineer, decompile, or disassemble the software except as permitted by applicable law
- Circumvent license verification mechanisms
3. Your Data
Sophon is a self-hosted platform. You retain full ownership of and responsibility for all data processed by your Sophon instance, including conversations, documents, memory, credentials, and configurations. Buildersoft does not access, collect, or store your runtime data.
You are responsible for securing your Sophon deployment, including network access, credential management, backups, and compliance with applicable data protection regulations.
4. Third-Party Services
Sophon integrates with third-party services (LLM providers, messaging platforms, SaaS applications) at your direction. Your use of these services is governed by their respective terms and policies. Buildersoft is not responsible for the availability, accuracy, or conduct of third-party services.
5. Marketplace
The Sophon Marketplace hosts skills created by Buildersoft and third-party developers. While we review marketplace submissions, we do not guarantee that all skills are free of bugs, security vulnerabilities, or malicious content. Skills run in a sandboxed environment, but you should review skill permissions and descriptions before installation.
6. Disclaimer of Warranties
SOPHON IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. BUILDERSOFT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SOPHON WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDERSOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF SOPHON, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO SOPHON SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
8. Indemnification
You agree to indemnify and hold harmless Buildersoft from any claims, losses, or damages arising from your use of Sophon, your violation of these Terms, or your infringement of any third-party rights.
9. Termination
You may stop using Sophon at any time by uninstalling the software. Buildersoft may terminate or suspend access to Pro and Enterprise features if you breach these Terms or if your license expires. Upon termination, your data remains on your infrastructure and is not affected.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
11. Changes to These Terms
We may modify these Terms from time to time. Updated Terms will be posted on this page with a revised date. Continued use of Sophon after changes constitutes acceptance of the updated Terms.
